1. Agreement to Terms

By using The Baby Logger (the "Application"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Application.

2. Use of the Application

You must be at least 18 years old to use this Application. You are responsible for your account and for any activity that occurs through your account. You agree not to use the Application for any illegal or unauthorized purpose.

3. Subscriptions and Payments

The Application is a paid service provided on a subscription basis ("Subscription(s)"). While we may offer a limited trial or initial entry, continued access to the Application's logging, history, and AI insights requires an active Subscription. You can purchase a Subscription either directly through our website (processed by Stripe) or through the iOS Application (processed by the Apple App Store).

3.1 Billing and Automatic Renewal

  • Billing Cycles: Subscriptions are billed in advance on a recurring and periodic basis (monthly or annual).
  • Automatic Renewal: Your Subscription will automatically renew at the end of each Billing Cycle under the same conditions unless you cancel it or we cancel it.
  • Cross-Platform Access: An active Subscription on either platform (Web or iOS) grants full access to premium features for the associated baby profile across all devices.

3.2 Managing Your Subscription

You must manage your Subscription through the platform where it was originally purchased:

  • Web Purchases (Stripe): Manage or cancel via the "Account Settings" page or the billing portal link within the web application.
  • iOS Purchases (Apple): Manage or cancel through your Apple ID settings on your iOS device (Settings > Apple ID > Subscriptions).

3.3 Free Trials

We may offer Subscriptions with a free trial period. For Stripe purchases, you must cancel before the trial ends to avoid being charged. For Apple App Store purchases, trial management and cancellation are governed by Apple's policies and must be handled via your Apple ID settings.

3.4 Refunds

  • Stripe: Except when required by law, paid Subscription fees are non-refundable.
  • Apple App Store: All purchases and refund requests for Subscriptions made through the App Store are handled exclusively by Apple. We cannot issue refunds for Apple transactions.

4. User Content

You are solely responsible for the content, such as logs and profile information, that you post, upload, or otherwise make available through the Application. You retain all ownership rights to your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of operating and providing the Application.

5. Medical Disclaimer

The Baby Logger is an informational tool and is not intended to provide medical advice. The recommendations and insights provided by the application are for general informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

6. Termination

We may terminate or suspend your access to the Application at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Limitation of Liability

In no event shall The Baby Logger, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Application.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page.

10. Additional Software License Terms

The Application is licensed to you under Apple’s Standard Licensed Application End User License Agreement (EULA). By using any portion of the Application (whether on iOS or Web), you agree to be bound by the terms of the Standard EULA in addition to these Terms of Service.

You acknowledge that these Terms of Service are between you and The Baby Logger only, and not with Apple. We, not Apple, are solely responsible for the Application and the content thereof. You further acknowledge that Apple is a third-party beneficiary of these Terms of Service and has the right to enforce them against you.

In the event of a conflict between these Terms of Service and Apple’s Standard EULA, these Terms of Service shall prevail.
